These Terms of Service ("Terms") govern your access to and use of the RCS Weekly Newsletter ("Field Notes from RCS"), operated by Roberts Corrosion Services, LLC ("RCS," "we," "us," or "our"), accessible at https://newsletter.rcswv.com/. By subscribing to, accessing, or using the Newsletter, you agree to be bound by these Terms. If you do not agree with these Terms, please do not subscribe or access the Newsletter.

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the Newsletter site and updating the "Effective Date" above. Your continued use of the Newsletter after such changes constitutes your acceptance of the updated Terms.

1. Description of the Newsletter

"Field Notes From RCS" provides educational content related to corrosion control and cathodic protection. Our goal is to offer valuable insights to professionals and enthusiasts in the industry, promoting learning and positioning RCS as a thought leader. Currently, all content is available for free to subscribers. In the future, we may introduce paid subscriptions for access to additional premium content. We will notify subscribers of any such changes in advance.

2. Eligibility and Subscription

  • You must be at least 18 years old or the age of majority in your jurisdiction to subscribe.
  • Subscription is free and requires providing a valid email address. By subscribing, you agree to receive the Newsletter and related communications from us.
  • You are responsible for maintaining the accuracy of your subscription information and for any activity under your account.
  • We reserve the right to refuse or terminate subscriptions at our discretion.

3. Intellectual Property and Content Use

All content provided through the Newsletter, including text, articles, images, videos, and any other materials (collectively, "Content"), is owned by RCS or its licensors and is protected by copyright, trademark, and other intellectual property laws.

  • Permitted Use: You may access and use the Content for your personal, non-commercial, educational purposes only. This includes reading, learning from, and applying the information in your professional development within the corrosion control and cathodic protection industry.
  • Restrictions: You may not:
    • Reproduce, distribute, modify, create derivative works from, publicly display, or perform the Content without our prior written permission.
    • Use the Content for any commercial purpose, including selling, licensing, or incorporating it into products, services, or materials for financial gain.
    • Share, republish, or redistribute the Content on other websites, newsletters, social media, or platforms without attribution and our express consent.
    • Use the Content in a way that implies endorsement by RCS or misrepresents its source.
  • If you wish to use the Content for any purpose beyond personal education (e.g., in training materials, publications, or commercial endeavors), please contact us at mroberts@rcswv.com for permission. Unauthorized commercial use may result in termination of your subscription and legal action.

4. User Conduct

You agree not to:

  • Use the Newsletter in any unlawful, harmful, or abusive manner.
  • Attempt to interfere with the Newsletter's operation, including hacking, transmitting viruses, or overloading the system.
  • Impersonate others or provide false information during subscription.
  • Harvest or collect subscriber information for spam or unauthorized purposes.

5. Privacy

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, available at https://rcswv.com/privacy-policy. We do not sell, rent, or share your information with third parties for marketing purposes, as detailed in the Privacy Policy. By using the Newsletter, you consent to our data practices as described therein.

6. Future Paid Subscriptions

We may introduce paid tiers in the future, granting access to exclusive content. If you choose to upgrade, additional terms (e.g., payment details, cancellation policies) will apply and be provided at the time of upgrade. Free subscribers will continue to have access to basic content, subject to these Terms.

7. Disclaimers and Limitation of Liability

  • The Content is provided for informational and educational purposes only and does not constitute professional advice, consulting services, or endorsements. RCS makes no warranties regarding the accuracy, completeness, or suitability of the Content for any particular purpose.
  • TO THE FULLEST EXTENT PERMITTED BY LAW, RCS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
  • IN NO EVENT SHALL RCS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE NEWSLETTER OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICH IS CURRENTLY $0 FOR FREE SUBSCRIBERS).

8. Indemnification

You agree to indemnify, defend, and hold harmless RCS, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your violation of these Terms or misuse of the Content.

9. Termination

We may terminate or suspend your subscription at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to access the Newsletter and Content ceases immediately.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of West Virginia, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in West Virginia.

Amendment to Terms of Service for "Field Notes from RCS" Newsletter

Amendment Effective Date: January 09, 2026

This Amendment modifies the Terms of Service effective January 01, 2026 (the "Original Terms"). All terms not expressly amended herein remain in full force and effect. By continuing to use the Newsletter after the Amendment Effective Date, you agree to this Amendment.

Replacement of Section 6: Paid Subscriptions

Section 6 of the Original Terms ("Future Paid Subscriptions") is hereby deleted in its entirety and replaced with the following:

6. Paid Subscriptions

We offer optional paid subscription tiers ("Premium Subscriptions") that provide access to exclusive premium content beyond the free tier. Premium Subscriptions are available at the following rates (subject to change with notice):

  • Monthly: $5.99 USD, billed monthly.
  • Annual: $59.99 USD, billed annually (equivalent to approximately 17% savings over monthly billing).

Premium benefits include:

  • Access to additional in-depth content, such as deep dives into advanced corrosion control and cathodic protection topics.
  • Unbiased product reviews and industry analyses.
  • The ability to request specific topics for future articles (subject to our editorial discretion and feasibility).

Billing and Payment:

  • Payments are processed securely through our third-party payment provider, Stripe. By subscribing, you authorize us (via Stripe) to charge your provided payment method on a recurring basis according to your selected plan.
  • All fees are non-refundable except as required by law. Taxes (e.g., sales tax or VAT) may apply based on your location and will be added at checkout.
  • We may update pricing with at least 30 days' notice via email or on the Newsletter site. Your continued subscription after such changes constitutes acceptance.

Cancellation and Refunds:

  • You may cancel your Premium Subscription at any time through your subscriber portal (accessible after logging in) or by contacting us at mroberts@rcswv.com. Cancellation takes effect at the end of your current billing period—no prorated refunds for partial periods.
  • If you cancel an annual plan mid-term, you retain access until the end of the paid year, but no refund will be issued.
  • We reserve the right to terminate or modify your Premium Subscription for violations of these Terms, with no refund obligation.

Free Tier Continuity: Free subscribers will continue to have access to basic content without charge, subject to these Terms. Upgrading to Premium is optional and does not affect your free access rights.

Additional Changes

  • Section 7. Disclaimers and Limitation of Liability: The last sentence of this section is amended to read: "OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS."
  • Section 11. Contact Us: Add the following: "For billing or subscription inquiries, please email mroberts@rcswv.com or use the subscriber portal."

This Amendment incorporates by reference all other provisions of the Original Terms. In the event of any conflict, this Amendment prevails.
